Fiduciary Duty

By Tim Nichols

In plain English

A duty arising from a relationship of trust or a legally recognized role, which may require loyalty, care, or other obligations. Its existence, beneficiary, and scope depend on the role, documents, relationship, and law. Texas LLC co-members do not automatically owe each other every fiduciary duty merely because they own together.
