Contracts

Force Majeure

By Tim Nichols

In plain English

A contract provision allocating the consequences of specified events outside the affected party's control. Depending on its wording, it may excuse, suspend, or permit termination of performance. An unexpected event or increased expense does not automatically qualify; causation, notice, exclusions, and mitigation requirements can determine the result.
