Fraudulent Inducement

By Tim Nichols

In plain English

Fraud that causes a person to enter an agreement, typically through a qualifying misrepresentation, intended and justified reliance, and resulting injury. The elements depend on applicable law. A later failure to perform is not, by itself, proof that the party fraudulently induced the contract.
