Arbitration

By Tim Nichols

In plain English

A private dispute-resolution process in which an arbitrator or panel decides a dispute under an agreement or applicable law. An award is often binding and subject to limited judicial review. The arbitration clause can determine which claims are covered, the procedures, location, costs, and decision-maker.
